ARTEES
TERMS & CONDITIONS | updated 10.29.2026
1. Acceptance and Scope
By placing an order, approving a quote or proof, paying a deposit, or using our ordering services, the customer (“Customer”) agrees to these Terms & Conditions (“Terms”). A person ordering for an organization represents that they are authorized to bind that organization. Any modification must be agreed to in writing by Artees. A separately executed agreement takes precedence to the extent of a direct conflict.
2. Quotes, Pricing and Availability
Quotes are valid for 30 days unless stated otherwise. Pricing is based on the artwork, decoration method, garment or substrate, quantities, and delivery specifications quoted. Changes may require repricing and revised timelines. Prices exclude applicable taxes, freight, expedited service, and other charges unless expressly included. Product and material availability is subject to confirmation.
3. Order Confirmation and Production Authorization
An order is ready for production only after Artees receives and accepts all required items: final quantities and sizes, product specifications, print-ready artwork, written approval of the proof, and the required payment or approved credit authorization. Production schedules begin only after these requirements are complete and materials are available. Verbal discussions do not override the approved written specifications.
4. Artwork, Proofs and Color Variations
Customer must supply artwork in a suitable production format (such as AI, EPS, PSD or production-ready PDF; raster artwork generally at 300 DPI at final size). Artees may charge for cleanup, conversion, digitizing, separations, or design work, with fees disclosed before work begins. Digital proofs represent layout and placement, not an exact guarantee of printed or embroidered colors, scale, or texture. Customer is responsible for reviewing spelling, logos, dimensions, placement, garment colors, sizes, and quantities before approval. Reasonable variations in ink, thread, garment dye lots, positioning, and decoration appearance may occur due to production processes. Exact color matching or placement tolerances must be agreed in writing before production.
5. Artwork Revisions
Up to three artwork revisions are included unless the quote specifies otherwise. Additional revisions are $25 each. Major redesigns, new concepts, or changes after final approval may be quoted separately and can reset production timelines.
6. Minimum Quantities
Orders must meet the minimum quantities stated in the accepted quote or invoice. Different decoration methods, garments, and designs may have different minimums.
7. Standard Production Lead Times
Estimated standard production times, measured in business days after all production requirements are satisfied, are: screen printing 7–10 days; embroidery 10–14 days; DTF transfers 5–7 days. These are estimates, not guaranteed delivery dates. Holidays, material shortages, customer changes, equipment issues, and other factors may affect timing. Transit time is additional unless expressly stated.
8. Rush Orders
Rush orders require written request and Artees acceptance based on capacity. For accepted orders requiring production in fewer than five business days, a 25% rush fee applies; for three business days or fewer, a 50% rush fee applies. Rush fees apply to the production/decorating charges unless the quote states otherwise. Expedited freight is additional. Rush scheduling does not guarantee carrier delivery.
9. Payment and Credit
A prepayment in the amount stated on the quote or invoice is due at order placement; the remaining balance is due when the order is completed and before release or shipment, unless Artees approves written credit terms. Customers with approved credit must pay according to their agreed terms. Past-due balances may accrue a service charge of 1.5% per month or the maximum permitted by law, whichever is lower. Artees may suspend production, shipment, or future orders for overdue balances, subject to applicable law.
10. Changes and Cancellations
All requested changes or cancellations must be submitted in writing and are effective only when acknowledged by Artees. Once an order is approved, Customer is responsible for nonrecoverable materials, committed third-party charges, work performed, and other documented costs incurred through cancellation. Changes may result in additional charges and a revised completion date. Custom-decorated goods generally cannot be returned for buyer’s remorse or changed preferences.
11. Quantity Variances and Exact Quantity Orders
Artees aims to deliver the ordered quantity, but production overruns or underruns of up to 2% may occur unless a written exact-quantity commitment applies. Invoicing will reflect the actual quantity delivered, subject to the accepted quote and applicable law. For orders requiring precisely the stated count, Customer may request an Exact Quantity Guarantee before production; availability and any applicable fee must be confirmed on the quote. No exact-quantity guarantee is implied without written acceptance.
12. Customer-Supplied Goods and Materials
Customers are responsible for inspecting and verifying all garments and materials before delivery to Artees. Artees does not perform incoming garment inspections or piece-by-piece inventory verification.
Customers are encouraged to provide additional units to cover potential production spoilage. Artees is not responsible for preexisting defects, incorrect quantities, mislabeled sizes, inconsistent materials, or outcomes caused by the properties or condition of customer-supplied goods.
Normal production processes carry an inherent risk of spoilage or damage. Any agreed spoilage allowance or replacement obligation must be documented in writing. Nothing in these Terms excludes liability that cannot lawfully be excluded.
13. Inspection, Defects and Claims
Customer must inspect goods promptly upon receipt and notify Artees in writing of visible defects, shortages, or order errors within five business days, including photographs, quantities, and order reference where practical. Artees will review timely claims and may, at its discretion and subject to applicable law, repair, replace, reprint, or issue a credit for verified nonconforming goods. Claims concerning latent defects that could not reasonably be discovered on delivery will be handled as required by applicable law. Goods should not be distributed, altered, or used before Artees has a reasonable opportunity to inspect a reported issue.
14. Shipping, Delivery, Pickup and Storage
Shipping charges and methods are as specified on the quote or invoice. Estimated delivery dates are not guaranteed unless expressly agreed in writing. Artees is not responsible for carrier delays outside its reasonable control, but will assist with available tracking and claims information. Customer must provide accurate shipping instructions and arrange timely pickup when notified that an order is ready. Any storage charges or disposal of unclaimed goods require advance written notice of the applicable policy and a reasonable opportunity for pickup, subject to law.
15. Intellectual Property and Customer Content
Customer represents that it has the necessary rights and permissions to reproduce all artwork, logos, trademarks, text, and other content supplied for an order. Customer will defend and indemnify Artees against third-party claims arising from Customer-provided content, except to the extent caused by Artees’ own misconduct. Artees retains ownership of its original artwork, production files, methods, website content, and other intellectual property unless transfer is expressly agreed in writing.
16. Website Use and Privacy
Customers must use the Artees website lawfully and may not interfere with its security, access, or operation. Website descriptions and prices may be corrected if inaccurate; Artees will contact the customer about material order changes. Links to third-party sites are provided for convenience and do not constitute endorsement. Personal information is handled under the applicable Privacy Policy published on the Artees website. These website-use provisions do not prohibit authorized business purchases or resale of legitimately purchased goods.
17. Limited Warranty and Limitation of Liability
Except for express commitments in the accepted quote and warranties that cannot lawfully be disclaimed, Artees makes no additional warranty regarding website availability or the suitability of a product for an unstated purpose. To the maximum extent permitted by law, Artees is not liable for indirect, incidental, special, or consequential damages, including lost profits or missed events. Its aggregate liability arising from an order will not exceed the amount paid for that order, except where such limitation is prohibited by law. These limitations do not excuse obligations imposed by applicable consumer protection or other nonwaivable laws.
18. Events Beyond Reasonable Control
Artees is not responsible for delays or nonperformance caused by events beyond its reasonable control, including natural disasters, supply chain disruptions, labor interruptions, government actions, and transportation interruptions. Artees will use commercially reasonable efforts to notify Customer and mitigate impacts. Payment obligations for completed work and nonrecoverable committed costs remain subject to the accepted order and applicable law.
19. Indemnification
To the extent permitted by law, Customer will defend and indemnify Artees and its personnel against third-party claims, losses, and reasonable legal expenses arising from Customer’s infringement of third-party rights, unlawful instructions, or misuse, distribution, or resale of goods, except to the extent resulting from Artees’ negligence, breach, or wrongful acts.
20. Governing Law and Disputes
These Terms are governed by Florida law, without regard to conflict-of-laws rules. Subject to applicable law, disputes will be brought in the state or federal courts located in Miami-Dade County, Florida. The parties will first attempt in good faith to resolve disputes through direct written communication.
21. General Provisions
If a provision is unenforceable, the remaining Terms remain effective. Failure to enforce a provision is not a waiver. Customer may not assign an order without Artees’ written consent. Artees may use qualified subcontractors while remaining responsible for its contractual obligations. These Terms, together with the accepted quote, proof, invoice, and any separately signed agreement, constitute the agreement for the order. Any conflict is resolved first by a separately signed agreement, then by specific written terms on the accepted quote, then by these Terms.
